The U.S. Justice Department was three hours from filing antitrust charges against Google when the search giant called of its advertising pact with Yahoo, according to an interview by American Lawyer Daily with Sanford "Sandy" Litvack, the high-profile lawyer who was brought in to advise regulators in the case.
"We were going to file the complaint at a certain time during the day," Litvack told the publication in the interview, published yesterday. "We told them we were going to file the complaint at that time of day. Three hours before, they told us they were abandoning the agreement."
The complaint would have alleged that Google had a monopoly in Internet advertising, and that the Yahoo pact would have added to that monopoly position, Litvack said in the interview. However, the article says it's not clear if that stance will apply to the Justice Department's future dealings with Google, particularly now that a new administration is taking office.
In the interview, Litvack denied that Microsoft's arguments against the Google-Yahoo deal swayed his position on the issue. He expressed confidence in the Justice Department's case and said he had been looking forward to arguing it.
