Amazon settles lawsuit over cracked Kindle readers |

Amazon.com as expected has settled a lawsuit over cracked Kindles. Seattle resident Matthew Geise sued the online retailer back in July, alleging that a Kindle he bought his wife as a birthday gift developed cracks in its plastic casing and eventually froze up due to an ill-fitting official leather Kindle cover. He had sought class action for the lawsuit and unspecified damages.
In a proposed settlement filed in U.S. District Court in Seattle today (pdf, 9 pages), Amazon agreed to replace affected Kindles and Kindle covers — not a huge stretch since the company already pledged to do that after the lawsuit was filed in July. Amazon will also send an email to people who bought Kindles along with branded Kindle covers notifying them of their warranty rights; refund $200 to people who paid that amount to replace Kindles that cracked due to covers; and pay $50,000 to plaintiff's lawyers. And Geise will get his own new Kindle and cover.
The settlement, which the two sides had earlier signaled they were working on, awaits court approval. Amazon followed a similar trajectory with another lawsuit over its deletion of George Orwell novels from Kindles. A Michigan high school student, Justin Gawronski, sued Amazon, alleging that the company caused his notes to disappear when it wiped out his Kindle copy of Orwell's "1984." Amazon settled with Gawronski and a co-plaintiff, enshrining previous pledges to refrain from such remote deletions in the future (with some exceptions).
