Microsoft asks court for further review of Word patent verdict |

Microsoft today asked a federal appeals court to reconsider its earlier decision to uphold a $290 million jury verdict and injunction in its patent dispute with i4i Inc. over custom XML technologies in Microsoft Word. Read the full text of the company's petition here: PDF, 48 pages.
"The petition details significant conflicts we believe the December 22 decision creates with established precedents governing trial procedure and the determination of damages, and we are concerned that the decision weakens judges’ authority to apply appropriate safeguards in future patent trials," said Microsoft spokesman Kevin Kutz, in a statement. "We look forward to the next steps as the Court considers our petition, while continuing to move ahead with our plans to comply with the injunction by January 11, 2010."
Microsoft is removing the disputed technologies from new copies of Microsoft Word to comply with the injunction, which would otherwise require the company to halt sales of the software altogether.
Ludon Owen, i4i chairman, said in a statement this afternoon, “This next step of seeking a rehearing was anticipated. We continue to be confident that we will prevail.”
He added, “In the meantime, the injunction against Microsoft goes into effect in three days, on Monday January 11. We look forward to continuing to build i4i’s business now that Microsoft is obligated to comply with the terms of the injunction. i4i stands ready to work with the wide range of customers that require this custom xml functionality.”
