A report today that a Microsoft-led consortium has withdrawn its plan to buy hundreds of Novell patents is being welcomed in some corners of the open-source community, but it looks like any celebrations are premature, and the deal is still on.
“This is a purely procedural step necessary to provide time to allow for review of the proposed transaction,” a Microsoft representative said in response to a TechFlash inquiry about the withdrawal of the plan from German regulators. The company provided no further details or comment about the reasons for the step.
The consortium, known as CPTN Holdings LLC, was revealed last month to include Apple, Oracle and EMC in addition to Microsoft. The group's acquisition of 882 Novell patents for $450 million is connected to the sale of the Linux vendor to Seattle-based Attachmate Corp.
The patent deal has raised concerns among open-source software leaders over the possibility for the CPTN companies to use the intellectual property against open-source technologies and interests.
