A federal court judge said Apple Inc.'s fight to prevent Amazon.com Inc. from using the name Appstore in selling software for Android will "probably" be denied, Bloomberg reports.
Apple (NASDAQ: AAPL), which has built a huge business around the name, said it would be irreparably harmed as consumers would be confused over the two services.
U.S. District Judge Phyllis Hamilton after a hearing in Oakland said she will “probably” deny the motion because Apple had failed to demonstrate real evidence of confusion among consumers.
Apple sued Amazon.com (NASDAQ: AMZN) for trademark infringement in March.
Amazon, which is selling software for devices using Google Inc.'s (NASDAQ: GOOG) Android operating system, argues the words "App Store" are generic, and that consumers cannot be confused since Apple's service sells programs only for Apple devices.
